THE PROMOTER AND THE T&CS

The promoter of all the competitions on our website (“our Website”): www.cometcompetitions.com is Comet Competitions Ltd (referred to herein as “We” or “Promoter”), a private limited company registered in Scotland under company number SC857456, registered office at Rinnes View Lettoch, Dufftown, Keith, Banffshire, Scotland, AB55 4BU. Our email address is support@cometcompetitions.com (“our Email Address”).

The T&Cs shall apply to all the competitions advertised on our Website. By submitting a competition entry, you, an entrant (“Entrant”), agree to be bound by the T&Cs in force at that time. We may make changes to the T&Cs from time to time, so please check them every time you use our Website, so to ensure you are aware of the T&Cs then current.

COMPETITIONS COVERED

We operate four main types of competitions:

  • The Comet Quest: A skill-based competition in which Entrants, having correctly answered a qualifying question, receive a clue at a designated time, and compete to be the first to locate the Prize at a hidden location.
  • Online Prize Draws: A skill-based competition in which Entrants, having correctly answered a qualifying question, may purchase tickets to be entered into a prize draw. Entry is available through both paid online tickets and free postal applications.
  • Offline Prize Draws: A skill-based competition in which Entrants, having correctly answered a qualifying question which will be displayed on an official Promoter poster, may purchase tickets to be entered into a prize draw. Entry is available through both paid cash payment and free postal route.
  • Instant Wins: chance-based prize draws where Entrants can find out instantly whether they’ve won. Each prize is randomly pre-assigned to specific entry times or codes before the draw begins. When an entry is submitted, our system automatically checks if it matches a winning moment. All Instant Wins are random, fair, and fully verified by the Promoter.

(each a “Competition”, together the “Competitions”).

HOW TO ENTER

A set number of tickets will be issued for each Competition. Tickets may be purchased online via our Website.

In respect of the Online and Offline Prize Draws, Entrants must purchase a ticket and answer a skill-based question correctly.

In respect of the Online and Offline Prize Draws, in addition to paid entries, a free postal entry route will be available, as set out at Part 1 of the Schedule below.

Entrants who answer the qualifying question incorrectly will not be entered into the draw, but their payment will still be processed.

Details of the free entry process and prizes, including deadlines and format, will be published on our Website.

The Competitions will remain open until the closing date and time displayed on our Website, which shall be the earlier of: (i) the specified date and time; or (ii) the point at which all tickets have been sold (the “Closing Date”). Note: the term “Closing Date” will mean the latest date, if extended due to a force majeure event, as defined in Part 2 of the Schedule, but then we will extend the Closing Date.

The Comet Quest

  • Tickets may only be purchased after correctly answering the qualifying question on our Website.
  • Each Entrant will receive a clue by email and on social media channels.
  • Entrants must use the clue to locate the Prize.
  • The first legitimate ticket holder to arrive at the location and scan the QR code (or other method, as set out on our Website) will be declared the winner (the “Winner”).
  • The Winner will then receive the prize.
  • Subject to the Winner’s consent, we may take and publish a photo of them at the winning location to be posted on our social media.

Note: you will open a free online account, registering your details online.

Online Prize Draws

  • Entries can be made via:
    • a) Paid Entry – purchase of tickets via our Website, by paying the stated price per entry and being allocated an entry number or entry numbers (each one being a separate transaction between us); or
    • b) Free Postal Entry – by complying with our postal entry requirements (set out in Part 1 of the Schedule) below, so that you can be allocated an entry number for each postcard received from you (each one being a separate transaction between us).
  • All valid entries, whether paid or free, will be entered into the same draw with equal chance of winning.
  • Winners will be selected at by a random number generator and will be announced via livestream.

Note: you will open a free online account, registering your details online.

Offline Prize Draws

  • Entries can be made via:
    • a) Paid Entry – purchase of tickets by placing the cash payment into the supplied entry envelope, together with your full name, date of birth and contact details. Seal the envelope and post it into the Promoter’s secure ballot box at the designated location. Each payment of the stated entry fee will be treated as a separate transaction, and you will be allocated the corresponding entry number(s). There can only be one answer per envelope.
    • b) Free Postal Entry – by complying with our postal entry requirements (set out in Part 1 of the Schedule) below, so that you can be allocated an entry number for each postcard received from you (each one being a separate transaction between us).
  • All valid entries, whether paid or free, will be entered into the same draw with equal chance of winning.
  • Winners will be selected by a random person picking an envelope at random from a ballot box.

ELIGIBILITY

Entrants must be aged 18 or over at the time and resident in the United Kingdom, although we wish to clarify that the Competitions are not open to (i) our employees; (ii) employees of our agents or suppliers or their holding or subsidiary companies, who are professionally connected with the competition; or (iii) members of the immediate families or households of any of the above.

By entering our Competitions, you confirm that you are eligible to enter and claim any prize you may win AND for these purposes:

  • (a) We may require proof of your eligibility;
  • (b) You accept full responsibility for any entry into the Competition outside of these eligibility requirements and for ensuring that you do not contravene any applicable law;
  • (c) We do not accept any responsibilities for unlawful competition entries;
  • (d) No refund shall be made in respect of any entry found to be ineligible;
  • (e) We may conduct age verification procedures to ensure compliance with the law, by which entrants and Winners may be required to provide proper identification (with photo ID) to verify their identity, age and place of residence.

We will not accept any entries which We reasonably believe –

  • (a) were automatically generated by computer;
  • (b) were completed by third parties;
  • (c) were bulk entries;
  • (d) are illegible, have been altered, reconstructed, forged or tampered with;
  • (e) were received after the Closing Date;
  • (f) cannot be matched to a registered Entrant;
  • (g) to be incomplete; or
  • (h) part of a series or scheme using multiple names and addresses, in which case all associated entries will be voided (whether by the paid or free entry route). Entries on behalf of another person will not be accepted, and joint submissions are not allowed.

We accept no responsibility for prospective entrants being unable to connect to our Website to participate in any ticket due to any technical or other problem relating to an email or web connection. Further, proof of transmission does not amount to proof of receipt.

Our Website may set out the maximum number of entries per person (whether online or via the free postal route).

Conduct contrary to the spirit or intention of the competitions may lead to disqualification at our absolute discretion.

Payments for ticket entries, and monies held as a credit balance in a registered Entrant’s digital wallet, are non-refundable, but may be applied to a future online ticket entry or entries.

THE PRIZE

Prizes will be described in detail on our website for each competition.

Prizes are non-transferable and no cash alternative is available unless otherwise stated.

Prizes for each Competition will be specified and will remain at the discretion of the Promoter.

Delivery or collection arrangements will be confirmed with the Winner.

WINNERS

Our decision as to all matters where we have a discretion, or where we apply the rules of these T&Cs, is final; and no correspondence or discussion concerning it will be entered into.

After the Closing Date, We will:-

  • not amend any contact information once registered by us; and
  • contact the Winner personally as soon as practicable, at our discretion either by email, using the email address provided upon registration, or by telephone.

Within 7 days after the Closing Date, we will publish on our Website the name of the Winner and the winning Entry Number (subject to their consent).

CLAIMING AND DELIVERY OF THE PRIZE

Delivery of the Prize to the Winner may take up to 14 days.

Delivery of the Prize will either be in person, or via a courier or delivery service (as determined by us). The cost of delivery is borne by us unless stated otherwise from the outset on our Website. A delivery charge may be made for bespoke delivery requirements of the Winner or for re-deliveries.

We will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or is not available or has not claimed the Prize within 21 days after the Closing Date, We reserve the right to offer the Prize to the next eligible entrant selected from the Entry Numbers allocated before the Closing Date, using the same method as previously mentioned.

If the Winner is unable to take up the Prize, or fails to do so within 21 (twenty-one) days after the Winner is announced, the Prize shall then become unavailable to the Winner and We shall have no liability whatsoever to the Winner.

LIMITATION OF LIABILITY

So as is permitted by law, we, our agents or distributors will not in any circumstances be liable to compensate the Winner, or nor have any liability for any loss, damage, personal injury or death occurring, as a result of taking up the prize, except where it is caused by the negligence of us, our agents or distributors or that of our or their employees. Subject to that, your statutory rights are not affected.

Entrants acknowledge that any travel undertaken in connection with the Competition, including but not limited to driving or other transport to a prize location, is at their own risk. We accept no responsibility or liability for any loss, damage, injury, or expense incurred by Entrants or third parties arising from travel to or from any location connected with the competition or prize. It is the sole responsibility of Entrants to ensure that they travel safely, in accordance with all applicable laws, and with appropriate insurance in place.

DATA PROTECTION AND PUBLICITY

We will process your personal information in accordance with [Our Privacy and Cookie Policy] and as mentioned above under “Winners”.

If we offer a prize in partnership with a third party, then the Winner is deemed to consent to their email address being shared with that party. If you wish to unsubscribe from any third party’s email list, you may do so at any time by clicking on the unsubscribe button at the foot of their email, if available and if not by emailing that third party.

We reserve the right to publish or make available information that indicates that a valid award took place for each Prize Draw – for example, the surname and town of residence of the Winner. The Winners have the right to object to all or part of this information being published or made available – in such event they should inform the Promoter in writing. In such circumstances, Entrants acknowledge that the Promoter must nevertheless still provide the information and winning entry to the ASA or equivalent regulator on request

By registering with us your details, you agree that We may send you future promotional materials by email from time to time, such as our newsletter and details of special offers that may be of interest. You may unsubscribe from this at any time in accordance with [our Privacy & Cookie Policy].

GENERAL

If there is any reason to believe that you are or have been a breach of these T&Cs, We may, at our sole discretion, reserve the right to exclude you from participating in any of our competitions.

Events (including but not limited to events of force majeure) may occur that render the awarding of the prize impossible due to reasons beyond our reasonable control and then We may at our absolute discretion vary, suspend, cancel or amend the Competition, and the Entrant agrees that We shall have no liability in such circumstances.

The prize draw will be live-streamed, so that the public may follow it via our social media channels as our Website mentions.

For the purposes of the Contracts (Rights of Third Parties) Act 1999 and otherwise Only you and Us (and no other party) may claim that the terms of the contract between us confer a benefit, either expressly or as a matter of contractual construction, on any other party.

All non-compliant entries will be deemed void.

The Website terms and conditions set out in Part 3 of the Schedule shall also apply provided that, where the content of Part 3 of the Schedule conflicts with the T&Cs, the T&Cs shall prevail.

Scots law shall apply to our Website and the T&Cs, and the Scottish courts shall have exclusive jurisdiction in relation to any dispute over them.

Schedule - Part 1

Postal Entry Requirements

To enter a Prize Draw by post:-

  • 1. register online, entering:-
    • 1.1 the name of the Competition in which you wish to participate
    • 1.2 the correct answer for the Competition being entered into
    • 1.3 your:-
      • (a) full name;
      • (b) date of birth – NOTE: you have to be aged 18 or over on the date on which you post your postcard;
      • (c) full postal address;
      • (d) email address; and
      • (e) telephone number.
  • 2. Send one unenclosed postcard per entry by ordinary first-class or second-class post to us (not exceeding the maximum number per entrant as stated on the Prize Draw Page), stating:-
    • 2.1 the name of the Prize Draw in which you wish to participate;
    • 2.2 your:-
      • (a) full name;
      • (b) date of birth – NOTE: you have to be aged 18 or over on the date on which you post your postcard;
      • (c) full postal address;
      • (d) email address; and
      • (e) telephone number.
  • 3. Address the postcard to the Promoter, as identified in paragraph 1 of the T&Cs.
  • 4. All details must be either typed or clearly written – NOTE: your entry will be invalid if the writing on your postcard is not legible, in our absolute discretion.
  • 5. Postal entries must be received before the Closing Date and any received after the Closing Date will be automatically disqualified.
  • 6. Entrants MUST have registered on our Website by the time each postal entry is received by us and all details on postcards MUST match the name and address on the account to which they are to be linked. In the event that We are unable to identify the registered account-holder and match it to a postcard entry, that postcard will be rejected.
  • 7. If you supply your email address, you will receive an email confirming receipt of your postal entry, letting you know that you have been entered into the Prize Draw, together with your Entry Number. All postal entries are treated in the same way as entries using the paid route, and you will have an equal chance of winning the Prize Draw as those who enter online.
  • 8. We will not accept:-
    • (a) any responsibility for postcard entries that are lost, mislaid, damaged or delayed in transit beyond the Closing Date, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, or systems, satellite, network, server, computer hardware or software failure of any kind; or
    • (b) proof of posting or transmission as proof of receipt of entry into the Prize Draw.
  • 9. NOTE: one entry per postcard – multiple entries are restricted as mentioned on our Website – if We believe one person is attempting to enter using multiple names and addresses, all associated entries will be voided, entries on behalf of another person will not be accepted and joint submissions are not allowed (as with the online paid entry route).

Schedule - Part 2

Force Majeure Events

Force majeure event means any circumstance not within our reasonable control including any:-

  • 1. act of God, flood, drought, earthquake or other natural disaster;
  • 2. epidemic or pandemic;
  • 3. terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;
  • 4. nuclear, chemical or biological contamination or sonic boom;
  • 5. law passed or action taken by a government or public authority, including imposing an export or import restriction, quota or prohibition;
  • 6. collapse of buildings, fire, explosion or accident;
  • 7. interruption or failure of utility service.

Schedule - Part 3

Website Terms and Conditions

  • 1. All defined terms contained in the T&Cs (as defined in the Prize Draw Terms and Conditions above) apply to this Part 3 of the Schedule.
  • 2. By using our Website, and entering our Competitions, you accept the Terms and that you agree to comply with them. If you do not agree to the Terms, you must not use our Website.
  • 3. Our Website is owned and operated as set out at paragraph 1 of the T&Cs.
  • 4. If you need to contact us, please email us at our Email Address as stated at paragraph 1 of the T&Cs, but you may not email us to enter the Prize Draw, as you can do so only as set out in paragraph 4 of the T&Cs.
  • 5. We recommend that you print and retain a copy of the Terms for future reference.
  • 6. We may make changes to the Terms from time to time, so please check the Terms every time you use our Website, to be sure you understand the Terms that apply at that time.
  • 7. We may suspend or withdraw our Website at any time.
  • 8. our Website is made available free of charge.
  • 9. We do not guarantee that our Website, or any content on it, will always be available and/or uninterrupted.
  • 10. We may suspend or withdraw or restrict the availability of all or any part of our Website for business and operational reasons, although We will endeavour to post on our Website reasonable notice of any proposed suspension or withdrawal where possible.
  • 11. You are responsible for ensuring that all persons who access our Website through your Internet connection are aware of the Terms and any other applicable terms and conditions, and that they comply with them.
  • 12. our Website is for users residing in the United Kingdom only.
  • 13. You must keep your account details safe.
  • 14. If you choose, or you are allocated, an Entry Number or other user identification code, password or any other piece of information as part of our security procedures or otherwise, you must treat such information as confidential and not disclose it to any third party.
  • 15. If you know or suspect that anyone other than you knows your Entry Number or other user identification code, password or any other piece of information provided as part of our security procedures or otherwise, you must promptly notify us at our Email Address.
  • 16. The competitions advertised on our Website are subject to the additional terms and conditions that are stated in the T&Cs and its schedules. You must ensure you have read, understood and agreed such terms before entering any of our Competitions.
  • 17. We are the owner or the licensee of all intellectual property rights on our Website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
  • 18. You may print off a copy, and may download extracts, of any page(s) from our Website for your personal use and you may draw the attention of others to content posted on our Website.
  • 19. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text nor use them on any other website or for any commercial purpose.
  • 20. Our status (and that of any identified contributors) as the authors of content on our Website must always be acknowledged.
  • 21. You must not use any part of the content on our Website for commercial purposes without first obtaining from us or our licensors a written licence to do so.

  • 26. We are not sponsored, endorsed, or administered by, or associated with Facebook, Instagram, or Tik Tok. By entering, Entrants confirm that they are aged 18 or over and based in the United Kingdom, release Facebook and Instagram of all responsibility, and agree to our Terms.
  • 27. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
  • 28. Please note that We only provide our Website for domestic and private use. You agree not to use our Website for any commercial or business purposes, and We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
  • 29. We will only use your personal information as set out in our Privacy and Cookie Policy.
  • 30. You are responsible for configuring your information technology, computer programmes and platform to access our Website. You should use your own virus protection software.
  • 31. We do not guarantee that our Website will be secure or free from bugs, viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful and you must not misuse our Website by knowingly introducing any such material. You must not attempt to gain unauthorised access to our Website, the server on which our Website is stored or any server, computer or database connected to our Website. You must not attack our Website via a denial-of-service attack or a distributed denial-of service attack.   • 37. We use the third-party online payment platform, “Cashflows” for payments.
  • 38. Wherever any of the Terms (i.e. contents of this Part 3 of the Schedule) may conflict with the T&Cs, then the T&Cs shall prevail.
  • 39. Scots law shall apply to the Terms and the Scottish courts shall have exclusive jurisdiction in relation to any dispute over them.
